Terms of Service

1. The agreement

These terms are an agreement between you and FamHQ ("we," "us") for your use of FamHQ Hosted at app.famhqapp.com and this website. By creating an account or using the service, you agree to them. If you're setting up FamHQ for a household, you're agreeing on behalf of the household's account, and you must be at least 18 (or the age of majority where you live).

2. Your household account

The person who creates the household is its owner. The owner manages the subscription, members and settings, and is responsible for activity in the household. Keep your sign-in details secure, and tell us right away at [email protected] if you think someone has accessed your account without permission. Adults are responsible for the profiles they create for children.

3. Subscription, trial and billing

• FamHQ Hosted costs $6.99 per month or $59 per year per household, plus any applicable taxes. The price covers all members, devices and features.
• New households get a 30-day free trial. Unless you cancel before it ends, your subscription starts and your payment method is charged.
• Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time in Settings. Cancellation takes effect at the end of the current period.
• Payments aren't refundable except where the law requires. If something went wrong, email us and we'll try to make it right.
• If we change prices, we'll tell you at least 30 days before your next renewal, and you can cancel before the new price applies.
• AI features include a monthly usage allowance (currently 50 requests per household per month, and 15 during the free trial). When a household reaches its allowance, AI features pause until the next month. Everything else keeps working.

4. Your content

You own the content your household adds to FamHQ. You give us permission to store, process and display it only as needed to run, secure and support the service for you. That permission ends when you delete the content or your household, apart from backups, which expire as described in our Privacy Policy. Only add content you have the right to share, including information and photos of other people.

5. Acceptable use

Don't use FamHQ to:

• break the law, or infringe on anyone's rights or privacy;
• harass, exploit or endanger anyone, especially children;
• try to access other households' data or our systems without permission, or interfere with the service;
• send spam or malware, or scrape or overload the service;
• resell the service without our written permission.

We may suspend or close accounts that break these rules. When it's safe and lawful, we'll tell you first and give you a chance to export your data.

6. Connected services and AI

Optional connections, such as Google sign-in, Google Calendar sync and AI features, are also governed by those providers' terms. Our Privacy Policy explains what we exchange with them. AI output can be wrong, so check suggestions before you rely on them. FamHQ always asks you to review AI suggestions before saving them.

7. Self-hosted software

The FamHQ software you run yourself is licensed under the GNU Affero General Public License v3.0, not these terms. When you self-host, you're responsible for your installation, including its security, backups, updates and any services you connect.

8. Changes to FamHQ and these terms

We're always improving FamHQ, so features may change. If we remove a core feature or change these terms in a way that matters, we'll tell you at least 30 days in advance. If we ever shut down FamHQ Hosted, we'll give you at least 60 days' notice and a way to export all your data.

9. Ending your account

You can cancel at any time and ask us to delete your household. After a subscription ends, we keep your content for 90 days so you can export it or come back, then delete it as described in our Privacy Policy.

10. Disclaimers and liability

FamHQ is a planning tool. Don't rely on it as your only record of something critical, like medication schedules or legal deadlines. We work hard to keep it running and your data safe, but the service is provided "as is," without warranties of any kind, to the extent the law allows. To the extent the law allows, FamHQ won't be liable for indirect or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection laws that can't be waived.

11. Governing law

These terms are governed by the laws of the State of New York, USA, apart from its conflict-of-law rules. Disputes will be resolved in the state or federal courts located there, unless your local consumer law gives you the right to bring a claim where you live.
